Menifee Woman Among Suspects in Attempted Murder

Sheriff's Department investigators are asking for the public's help in locating two suspects still at large related to a December 2014 attempted murder case in which a Menifee woman and two others are being held on $1 million bail.

The two remaining suspects identified by police are Pedro Gomez, 25, (left) and Aaron Ulises Correa Rodriguez, 24, both residents of Jurupa Valley. Gomez and Rodriguez are wanted for conspiracy to commit murder.

On Dec. 30, 2014, at approximately 9:30 p.m., deputies from the Lake Elsinore Station responded to the 32000 block of Edmond Street in the community of Good Hope. There they discovered a male adult suffering from multiple gunshot wounds. The victim was transported to a local hospital, where he was treated for non-life threatening injuries.

The next day, investigators identified and arrested Judy Avalos, 20, (right) of Menifee for conspiracy to commit murder. Avalos was booked into the Robert Presley Detention Center

Additional arrests were made as the investigation continued. On Jan. 22, investigators arrested 19-year-old Jurupa Valley resident Anthony Reyes in Rowland Heights for conspiracy to commit murder. On March 11, 21-year-old Jurupa Valley resident Carlos Ortiz was arrested in Riverside on the same charge. Both suspects are being held at the Larry D. Smith Correctional Facility.

EMWD Notes Progress in Residents' Water Conservation

Although the Eastern Municipal Water District has not limited its customers to certain days of the week for outdoor watering, EMWD officials want to remind Menifee residents of its suggested water restrictions and to thank them for their efforts in conserving water.

Some neighboring water districts have enacted more severe limitations on outdoor water use. Elsinore Valley Municipal Water District, which serves Lake Elsinore and parts of Canyon Lake and Murrieta, has a mandatory schedule limiting such water use. Residents with addresses ending in odd numbers may only water outside on Monday and Thursday. Even numbered addresses may water only on Tuesday and Friday. Sprinkler systems may only be turned on after 6 p.m. and before 6 a.m.

While EMWD has not gone to that extreme for Menifee residents, strict guidelines are in place to comply with a ruling by the State Water Resources Control board that this service area must reduce usage by 28 percent compared to 2013 figures. According to EMWD spokesman Kevin Pearson, EMWD customers did reduce usage by 27 percent in May compared to 2013 figures, though May 2015 had cooler weather and some rain, so the numbers were skewed.

"At this time, EMWD is asking its customers to reduce outdoor irrigation by 50 percent," Pearson wrote in an email to Menifee 24/7. "More than half of all residential water use in our region is for outdoor irrigation.

"We are not currently telling customers what days they have to water or the number of days. For some customers (especially those with slopes on their properties), it may be more efficient to continue watering multiple days, but in shorter cycles. Other customers may prefer to water twice a week for the same length as they have previously done. We are leaving those decisions in the hands of our customers."

Pearson emphasized that the greatest area of sacrifice expected is in watering lawns. Customers are told to do what is necessary to keep trees and shrubs sufficiently watered, but it is expected that there will be some browning of lawns.

Residents have expressed concern to EMWD and Menifee 24/7 about letting their lawns brown or die -- especially those governed by Homeowner Association rules. But Assembly Bill 2100, signed into law by Gov. Brown last July, prohibits HOAs from fining residents if they let their lawn go. Of course, the goal is to keep lawns from dying. In some cases, hand watering of brown spots is encouraged over sprinkler use that can have wasteful run-off.

Pearson said EMWD is in Stage 4, the highest level or urgency in its Water Shortage Contingency Plan, reducing the amount of water customers may use before facing additional fees. For details, visit the EMWD website here.

EMWD has also made changes to its Administrative Code that will eliminate non-functional turf in future development, including the front lawns of newly constructed homes.

"This is in sequence with the state’s decision to prohibit overhead spray sprinklers in new development," Pearson said. "These actions will create a much more sustainable template as we move forward."

Pearson also took the time to thank EMWD customers for their help in addressing the problem.

"Our customers have done a great job conserving and we hope they are able to continue to do so," Pearson said. "We know it is a sacrifice and we appreciate their partnership in this process."

Terry Smith Sr.: 'I Have Faith the Truth Will Come Out'

Two years after 11-year-old Terry Smith Jr. was found murdered in his family's back yard in Menifee, partial cremated remains of the boy are buried under a marker that carries only his nickname -- Juju -- at Menifee Valley Cemetery on Murrieta Road.

Joy Torrez, cemetarian at the facility, said residents occasionally stop by to ask whether Terry Smith's cremains are located there. Officially, there is no entry in the cemetery records under his name, at the request of his mother, Shawna Smith. But anyone who knows the nickname Juju is directed to a spot under a shade tree where those who remember that horrendous week in July 2013 can pay their respects.

This Thursday, July 16 at 3 p.m. on CBS television, the Dr. Phil Show will discuss a case that has stayed in the minds of Menifee residents ever since the events of that hot summer week two years ago. Realizing the renewed interest in the case because of the TV show, Terry Smith Sr. wants local residents to know that there is a local resting place for his son.

"A lot of people in Menifee still really miss Juju," the boy's father told Menifee 24/7 in a phone interview Monday. "I wanted them to know where his resting place is."

Actually, Terry's remains were split between Shawna and Terry Smith Sr. (left) after his cremation. According to Torrez, it took several months following the coroner's 2013 identification of the remains before the cremains were split and Shawna had the partial cremains placed at Menifee Valley Cemetery.

That was just the latest battle between Shawna Smith and Terry Smith Sr. regarding the case. Smith, who was divorced from Shawna and living in West Virginia at the time of his son's death, insists to this day that Shawna was involved in the murder.

"The people of Menifee ... they’re all still waiting for the same thing as me," Terry Smith Sr. said. "They’re waiting for answers – not some cock 'n bull story somebody’s trying to pass around."

On July 10, 2013, investigators found the boy's body buried in a shallow grave behind the home Shawna Smith shared with a companion on Helen Lane in rural Menifee. That was four days after he had been reported missing, leading to a search by thousands of local residents.

On Aug. 15, 2014, Terry's half brother, then 17-year-old Skylor Atilano, admitted to voluntary manslaughter. He was sentenced in juvenile court and cannot be held past the age of 23. Because it was a juvenile case, details of the murder are sealed.

Shawna Smith has since moved out of the home owned by her companion, Dennise Bugna. Several sources said she lives somewhere in the San Diego area. A phone number used by Menifee 24/7 to reach her in the past has been disconnected.

In Monday's phone interview, Terry Smith Sr. said Dr. Phil McGraw, the host of the television show, said on the air that he had tried unsuccessfully to gain an interview with Atilano (right). The show's producers did fly Smith and his daughter Hannah out from West Virginia for the taping, and Shawna Smith was also present.

The show was taped in August of 2014 but has never aired. According to Terry Smith, the original air date was canceled and he was later told that the show's producers were advised by attorneys not to air it because of a pending wrongful death lawsuit Terry Smith Sr. filed against Shawna Smith and Bugna, accusing them of gross negligence in leaving the boy home alone with his half brother.

It took a petition signed by many of Terry Smith's supporters and numerous emails to the Dr. Phil Show to convince the producers to finally air the show, Smith said.

Smith said Shawna maintains her innocence on the show and reads a later she claimed was written by Atilano. Later in the show, according to Terry Smith Sr., Dr. Phil got Shawna to admit the letter was written by someone else.

So does Terry Smith Sr. believe the show reveals any answers in the case?

"Other than the fact she went ahead and lied a lot more, not really," he said about his ex-wife (left). "I know she helped bury him. She's got Skylor so scared still, and (Child Protective Services) has me blocked from talking to him.

"I do know she’s with somebody else and she’s saying life is great. Me, I’m still trying to get over the fact he was murdered and nothing came out of it. But I still have faith that somebody will slip up and the truth will come out."

Kuenzi, Sobek Pull Papers to Run for Council Seat

Former Menifee City Council member Darcy Kuenzi and current Planning Commissioner Lesa Sobek have become the first to pull nomination papers to run for the vacant council seat.

Monday was the first day potential candidates could schedule an appointment with the city clerk to pull papers for the seat left vacant upon the May 26 death of Wallace Edgerton. That seat will remain vacant until a new council member is elected on Nov. 3 to serve the remaining one year of Edgerton's term.


Kuenzi (right) was a member of the original Menifee City Council in 2008 and served until 2012, when she lost an election for mayor to Scott Mann. She has remained active in local community affairs. Kuenzi has been a Menifee resident since 1992.

Sobek (below) was appointed to the Planning Commission by Mann in December 2012. She has been actively involved in many community issues in addition to her Commission duties. She has been an integral part of the "Menifee Better Together" service project and has served as chair of the Menifee Interfaith Council.

In a letter to council members and selected other individuals before his death, Edgerton named Sobek as one of three suggested replacements. Residents spoke on Sobek's behalf at a June 3 council meeting, but council members voted to select the new council member by special election, not appointment.

The new council member will represent District 3, the southeast part of the city. Only District 3 residents will vote in the election and only residents of that district may run for the position. Candidates have until Aug. 7 to be certified for the election, a process including the return of a petition with at least 20 signatures of registered voters.
